全球两百位学者要求释放沈梦雨和被捕工友 声援团呼吁全国进步人士前往坪山

  1. 目前全球已有超过二百名学者加入此联署。

  2. 目前尚有十四名工友被拘留当中。

  3. 2018年8月11日,声援团代表沈梦雨被强行带走,至今下落不明。

  4. 全国超过五十名来自北京、南京、湖南等地的大学生正赶赴深圳加入声援队伍。

  5. 声援团连日来不断受到来自警察及国安的骚扰和威吓。

  6. 我们要求当局必须立即释放十四名被捕工友以及声援团沈梦雨,并必须停止一切针对工友及声援团的恐吓及逼迫。


全球一百五十位学者就深圳坪山佳士科技工友筹建工会遭暴力事件致深圳市政府、深圳市总工会信**

今年5月,因深圳市佳士科技股份有限公司存在非法调休、实行违法罚款制度、未足额缴纳住房公积金、泄露员工信息非法建立黑名单等违法行为,其员工联名向坪山区人力资源局和总工会投诉。对此,坪山区总工会副主席及相关人员回复,员工可以组织工会、发展会员。在区总工会指示下,筹建工会的员工征集工友的入会意愿,多达89位工友签字申请加入工会。

然而,到了7月,坪山区总工会干部和佳士科技管理人员却指控工友自行筹建工会属违法行为。随后,厂方对筹建工会的员工采取非法调岗、开除、恐吓、抹黑等手段进行报复,警察则非法殴打、扣押,甚至以寻衅滋事罪刑拘建会工友和到现场声援的热心人士。截至目前,仍有30名被刑拘的建会工人、声援工人和学生未恢复人身自由 (名單在信末)。

佳士工友依法按照上级工会指示,自主筹建工会来处理劳资纠纷。但厂方和警察无视工人的合法诉求,以暴力违法手段阻挠和限制工人依法参加和组织工会的权利。中国作为工人阶级领导的社会主义国家,不应容忍这种违背工人阶级利益的行为。厂方和警察悍然违法的行为,也与习近平总书记十九大讲话中强调的”坚持全面依法治国”精神严重相悖。

此次事件也充分反映了当下中国劳资双方力量对比过于悬殊的问题。工人提出依法自主筹建工会,在法律框架内协调劳资纠纷,遭到了来自厂方、警方和上级工会的打压。而厂方违反劳动法律法规在先,却有能力调动警察和上级工会来阻挠和限制工友的合法建会诉求。工会本应充当政党与工人之间的桥梁,是实现工人阶级团结的组织。但在此次事件中,无论是基层的佳士工会,还是上级的坪山区总工会,表现都令人遗憾。它们的所作所为,不仅没有改变劳资双方悬殊的力量对比,甚至加剧了这一问题,和党作为工人阶级先锋队这一性质严重不符。

所以,为了保障劳动者的合法权益,贯彻党的十九大精神,维护中华人民共和国的国体,我们呼吁深圳市政府和深圳市总工会恰当处理这次佳士事件:

  • 立即释放所有被刑拘的建会工友和声援人士,取消其寻衅滋事罪罪名;

  • 严惩违法警察和厂方管理人员,赔偿工友因无法正常工作而遭受的经济和精神损失,并公开向工友道歉;

  • 深圳市政府和市总工会應該贯彻落实中华人民共和国《工会法》,支持佳士工友自主筹建工会的合法诉求。

我们希望,深圳市政府和市总工会能积极、理性干预此事,肯定工友的合法诉求,而非以暴力处理问题。唯有工人真正掌握了自我组织的权利,工会真正成为代表工人利益的组织,中国社会才能真正地体现社会主义核心價值,”中国梦”才有中国工人的一席之地,四十年改革开放才能跨越不平等而走向真正全面的社会发展。
